Presidential Election Petition Court

The Presidential Election Petition Court (PEPC), yesterday, adjourned hearing to today, following request by the presidential candidate of Labour Party (LP), Peter Obi.

At resumption of hearing, counsel for the petitioner and Senior Advocate of Nigeria (SAN), Awa Kalu, told the court that the initial plan of Obi’s legal team was to present documents to the court yesterday, but were challenged by the sudden illness of a key staff at the secretariat.

For this reason, Kalu said: “We are constrained to pray for an adjournment till tomorrow (today).”

Responding, counsel for the 1st, 2nd, 3rd and 4th respondents, Abubakar Mahmoud, Wole Olanipekun and Lateef Fagbemi, all Senior Advocates, did not oppose the application.

Justice Haruna Tsammani granted the prayer and consequently adjourned to today for continuation of hearing.

Meanwhile, the court admitted Forms EC8A, EC8E and EC8C of the Independent National Electoral Commission (INEC) as evidence for the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar.

Tsammani also admitted the certified true copy of printouts of the Bimodal Voter Accreditation System (BVAS) and accreditation data, in respect of 33 states, with the exception of Kaduna, Kano, Katsina and Lagos.

At the resumed hearing, counsel for the petitioner, Eyitayo Jegede (SAN), applied to tender from the bar-listed documents for admission.

The documents include the downloaded copy of INEC’s Form EC8A for Kaduna, Ogun and Bayelsa states.

Also tendered and admitted, as exhibits, were INEC’s Forms EC8C and EC40G for Kogi, Kaduna and Ogun states.

Hearing continues today.
